yes, your employer can file for a new H1B, but you will have to leave the country and get a visa to work on the H1B. An easier process would be for your new employer to take over the sponsorship of your GC by using AC-21.

Today Immigration Customs and Enforcement ("ICE") (http://www.ice.gov/pi/nr/0909/090910elcentro.htm) announced an arrangement with Imperial County Sheriff's Department in which individuals during the booking process will have their biometric data checked with Department of Homeland Security ("DHS") data and FBI data to determine whether or not they are in the United States illegally. When a person's fingerprints match those of someone in DHS' biometric data system, ICE is automatically notified. ICE will then take steps to determine the individual's immigration status and then take appropriate action after the offender completes his or her prison term.
ICE already has agreements with Los Angeles County and San Diego County. Nationwide coverage is expected by 2013.

Indian Government sources had said that the Bureau of Diplomatic Security had contacted the ministry of external affairs (MEA), India around the time Mr Pacheco was incarcerated for his alleged involvement in the mysterious death of his girlfriend Nadia Torrado � he was in jail from July 9 till July 26, when he was awarded bail. He is a former Goa, India tourism minister Francisco Xavier �Mickky� Pacheco was caught on the backfoot on Sunday once again as reports surfaced that the US State Department�s Bureau of Diplomatic Security had informed India that Mr Pacheco might be involved in a big immigration and money laundering racket.
Mr Pacheco used to operate an employment agency along with his estranged wife Sara Pacheco which specialized in finding employment for Goans abroad. But according to the former minister, he has had nothing to do with the agency since he separated from his wife around four years back.

It has limited relevance, the issue is the integrity of the Senator, he has admitted to the issue at hand but he went on the Senate floor as an elected public official to make declaratory and restrictionist anti-immigration statements, attacked immigrants, proposed and supported anti-immigrant ammendments and all this with the foundation of his positive public image, integrity and moral uprightness. We are thus not discussing the list he is on, but are simply taking note of the Senator's credibility on an issue that affects us. Anything beyond that would be inappropriate and not relevant to our issues.

As per Spet 2009 visa bulletin, my PD will be current . I recently moved to LA due to Job change . If i do AC 21, do you think i will miss a oppurtunity of getting GC in spet since my PD is OCT 2004.
Please advise. Should i do AC21 now ? Or Should i do only on RFE?
Another question. I still have permanent address in chicago but moved to LA. Do i need to do AC11 form?

I have the same problem...(The description of your problem is so similar to mine, I'm thinking that you might be my lawyer trying to fish for an answer to my problem...I paid her thousands of dollars and she gets her answers from the Internet...funny :D)

The I-140 was sent to Vermont, mine and my wife's I-485 have gone to "the office where they were transferred" (that really narrows it down) and my kid's I-485s were sent to Texas "it has jurisdiction over the case"
Since we live in Texas, I'm not sure why all our papers don't have Texan "jurisdiction".
My lawyers are inquiring with the USCIS and AILA (American Immigration Lawyers Association).

In general, if a green card holds stays outside US without any US ties for a long time, s/he technically abandons permanent residence. In practice, doing so may not trigger any activity from USCIS as such and the person may be able to enter US again. However, later on if s/he applies for US citizenship, s/he will likely be in trouble.
Usually people try to come back once every 6 months to maintain permanent residence. However, technically doing so is not sufficient; the key is maintaining ties in US in addition to not remain outside for too long.
You may be able to obtain advance permission from USCIS to remain outside US for a certain period of time without the risk of losing permanent residence. You may want to consult with an immigration attorney to know the options you have for your specific case.

I was employed by company A until from 2004 thru May'07 with labor and I140 approved in 2006, I was laid off from Company A in May'07 therefore I joined company B in June (transfered my H1).
In July , Company A agreed to file my I485 under future employment as all the EB catagories became current but I still work for company B (H1 with company B), now since in Jan'08 it will be past 180 days on my 485 application.
Can I file AC21 to change my employer to Company B and continue my I485 through to Company B?
Answer is Yes. Company B should be prepared to confirm that they have a job (same/similar as in original LC) which they will offer you on permanent basis upon your getting GC. Note that current job with B is on H1 (means it is not permanent).

The pamphlet covers the visa process, important documents, workplace and employee rights, human trafficking, and how to file a complaint. This is a very useful document, not just for immigrants. Applied for AP/EAD/485 in July 07.....I know that I can invoke AC21 after 180 days and change jobs.....My question is ,
1. If I travel to India before the 180 days and use the AP when I return, is it like invoking AC21 before 180 days ?
2. what are the consequences of using AP within 180 days after filing for 485 ?
3. Is AP and AC21 related ? [brother, sister , cousin :) ]
