Hi-
My current EAD was issued in 2007 when I filed I-485 + I-140 concurrently. It has since expired. I did not apply for a renewal because I am still on my H1B.
I am applying for a renewal now and had a question regarding filling out form I-765
Q15. Current Immigration Status ( Vistor, Student, etc )
I am still on my H1B. So I think I should write H1B and not AOS. But I am not sure.
I filled (C)(9) for Q16 Eligibility Criteria, and since I live in Ohio I am sending it to USCIS Phoenix Lockbox Facility. My receipt notice is Aug 2007 and to be sure I am including the $380 fee.

Recently we had been to India trip( Jan -Feb 2010), we also had expired H1 stampings but valid H1B.
You do not require Transit visa if you are passing through Frankfurt.

My wife came to USA in 2002 on H4.She changed from H4 to H1 in 2004 Nov.Since then she worked continuously till now (Jan 2009).Now she's planning to take a break and change back to H4.If she wants to work again sometime in future maybe after a couple of years will she come under quota?Does she have to apply for a new H1 or can she work the remaining 2 yrs left on her H1?We missed the bus and could not apply for 485 in July.

We need a handle to kick start a similar plead. In the last one year and quarter here at this forum, I had never seen one that CIS has done injustice to us by mis-interpreting a rule or law or act. If somebody knows otherwise, please state and cite facts. The class action suit ("Schneider vs. Chertoff") was filed by Shusterman on behalf of a group of international doctors in response to CIS regulations implementing the Nursing Relief for Disadvantaged Areas Act of 1999. Section five of the Act provides that "any alien physician" can qualify for a green card through a "National Interest Waiver," provided they practice in a federally designated health professional shortage area. The National Interest Waiver program is intended to accelerate the hiring of international doctors willing to serve in such areas.
In its regulations implementing the Act, the CIS stated that only primary care physicians, not medical specialists such as surgeons or radiologists, could qualify for green cards through a National Interest Waiver. The agency's regulations therefore eliminated the right thousands of international specialist physicians had to petition for green cards through the National Interest Waiver program.

I downloaded the 3dtools.dll from code plex website and added to reference in blend along with trackball codes therefore my zoom and rotate started working. But doesn't have pan functionality yet.

Hello Friends,
I am a new member and i am planning to join company. How long will take to tranfer visa from AAA to BBB? and one more doubt, is there any limitation to file Labour because i haven't file labour by current company. my new company may be filling my labour would take 3 to 4 months. is that making any problem to file labour after few months?

If you apply for premium, then you will have your I797 approval within 2 weeks. Otherwise it is taking 4 months(worst case). But you are ok to change your employer, with your fedex delivery receipt as long as it shows received by the USCIS office.
As for labor filing in PERM. Minimum time is two months + administrative process like lawyer's delay and employer's delay.
But they can also file a labor even before you join the company BBB.

Hi gurus,
I have been working with employer A since last 3 years. My I-140 (EB3)has been filed on April 1, 2008 and my priority date is January 9, 2008. I am planning on changing jobs within the same company but in a different state / city.
1)Would this affect my I-140 processing
2) Would this create any issues in the future stages of the green card process
3)Will I still be able to keep the same priority date for the I-485 (God knows when I'll get to that stage...)

I recently came back from India, and got a new I-94 at port of entry, but later I noticed that CBP officer added 10 more days to my I-94 expiry(it may be a mistake by the officer)

Hi,
I got a contract offer at company A (Industry: Health) at a big city. Currently I am working for a State Government as a contractor. As per salary is concerned not much of a difference between the two contract positions. Me and and my wife are currently working but at different places. 2-3 months back we thought of moving to a big place so that the probability of the other person getting job would be more and we can stay together at the same place so I applied for Company A. They accepted my resume but because of the economy and budget constraints they hold the position and after sometime I forgot about it. I dropped the idea of moving and didn't apply for any jobs because of the current economy situations. Now last week after more than 2 months they reopened that position and interviewed me and I got the offer yesterday. Now I am in a dilemma whether to take this offer at Company A or stay where I am until the economy goes little better. My current job is stable. Added to that my wife's contract getting over in Jan 2009. I am cracking my head here thinking what's right thing to do.
Scenarios:
1. If I moved to Company A and my job is good and then after Jan my wife can look for a job at that place. (chances are more because of Big City). Everything is good.

Not sure why you want to go to Consulate in India and why you have to mention to them about the 22 days. H1 will not be processed in the Consulate in India, it will be processed only here. If you are saying that in future when you go to the US Consulate in India for stamping then its not needed to mention about the 22 days, since you filed before the I-94 expiration. Do have a soft copy of the FexEx receipt saved for your future use.

H1b applied on Feb-2-2006 with old passport expiry date Oct-14-2006
H1b approved on May-9 dates May-9-2006 to Jan-31-2009
I applied for passport renewal sometime in March-2006
New passport sent by Washington DC with date Apr-25-2006 to Apr-24-2016.
So i had no issues getting h1b approval with passport expiring in few months.
i don't know if your attorney is right/wrong, but sharing my personal experience here.

You can apply for reneal of Green Card; that will be no problem. Best bet for citizenship is to wait four more years before applying.

You can only apply for extension 6 months before exipry.. so the earliest you can do is Mar 30th. Right now, USCIS is very keen on consulting cases, and RFE for client details is pretty much the norm. I got a similar RFE for which I responded, and nothing happened for more than a month. So I applied for premium processing, and they sent another RFE again. I am still waiting on the RFE, but I think it could be because my initial contract agreement (that my company probably sent in the response for RFE) had an end date of 2/28. It is now extended till June, but that is how my client works...
My advice,
1. try not to accept to be on bench... ask your employer to pay while on bench.
2. Apply for h1 extension well before your contract ends or do premium processing if the contract ends in less than 3 months.
3. Be prepared for an RFE. Make sure you can get client letters and such
hope you won't get into what I am experiencing for the last 11 months :(

I have been reading so many thread on filing but I haven't heard anything on what to do, look for after we file the 485 paper work
Can somebody provide the normal steps and what to expect after 485 gets filed. Is there a number you get, is there something you check online, what to expect in mail, what to check with the attorney, what is Finger printing, when to expect EAD, Travel Parole.. Do we need to call a hotline, I keep hearing Infopass. What is the final thing like do they stamp in the passport and we assume we have the GC? All I know is GC is not green:)
