Hello All,
My wife's AP was sent out on NOV13th according to online status and we didnt receive it till now and I called the USCIS today and the rep we didnt receive it back as undelivereable & once its once out of our office its not their concern & told re-applying is the only option.
Issue?: My wife went to INDIA and she is on L1 and I was wondering when I re-apply her AP here, can she enter while her AP is pending approval ?
her L1 is valid till June 2010.
What are our options, please advise.
If she has a valid L1 stamping in passport and she is still working for the employer she can enter without problems.

I am a labour substitution case pd feb 2002 filed 140 in June at NSC. My 140 has been pending for more than a year. Now recently I received 2 year ead.
Does this imply my 140 is approved too???
Is it safe to work on ead of one gets 2 year ead with pending 140.??

In that case, your L-1 is due to expire in September. Your employer can file an extension petition. Once approved, you will get a new form I-797 with a I-94 (valid for the extended period). The new I-94 will allow you to live in the US for that specific period. If you want to travel abroad, you have to get the new visa stamped on your passport.

Anything we can do to complain and bring attention to the EB3 processing delays at Nebraska service center?
As it was they were moving very slow and processing dates have been stuck in Jan 07 for past couple of months. Plus results show hardly any approvals this year so far especially for retrogressed countries.
To top it now a few people having spoken with nebraska are reporting that only 140's (EB3...this doesn't seem to apply to EB2 for some reason) with current priority dates are being processed. That they will only start processing again in May 08. Who's to say come May 08, they won't go back to square one and say "oh we're still processing jan 07 and we will only move a few days each month when it comes to processing dates"
Which would be fine if people weren't waiting, depending on the 140 approvals to a) keep their H1b status 2) go back on h1b status 3) change jobs.
I think this is totally unfair to do this to EB3 category. Why are they picking on EB3 category like this?

When E-Filed my EAD Reniewal , I didn't filled these fields (14. Manner of Last Entry & 15.Current Immigration Status) as they are not mandatory fields.Will there be any problem with my application?Anybody on the same boat?If so can you share your experiances?

Hi,
My U.S. born son is travelling with my friends from India to USA. He had gone to India for summer vacation. Would anybody have any sample letter for addressing to immigration authorities that we authorize his travel along with my friend.

US born child is citizen by birth and has RIGHT to enter United States. Immigration officials cant deny him the right to enter USA.
A simple letter saying that you have authorised your friend to accompany your child (minor) for the travel. The letter should have your contact address, cell etc

Hi All
I got a RFE on my Substitute 140 ( PD is 2005) where they are asking for 2007 tax returns which are not filed yet, applied for extension. 2005 and 2006 tax returns are good.
Can someone suggest me what to do in this situation.

My friend thats not a Rumour
I personally knows a person who got deported and each and every incidents what happened to him. That happened in Jan-10 but not sure if same thing still continue or not. Because I knows only one incident

If I were you, I would just do a little search in the forum and close this thread. There was an extensive discussion on this very topic for days and the thread had to be eventually closed because it was taking ugly turns. Let's not go that route again. I am on F-1 visa since Jan 2007. and got started my OPT in August 2009. I have on campus income through out the year in 2009. so how do I file the taxes, n which forms. for tax return 2009.
also I got married to a F-1 student in Jan 2009. She is also having her OPT started in August 2009. She has income only on OPT (from Aug to Dec 2009) so which forms she should also file.
my wife did paid her college fee in Jan 2009. and we have paid the rent through checks on leased apt.
So can she/we ask for deduction of any kind?
also which status we have to fill in. "Married filing jointly/separately".
please reply as soon as possible.

If both of you having 1098 forms from school you can file for Hope-credit (each gets $2500 credit, thats huge amount :) ). You cannot show the Apt. on tax form.

I am currently on H4 and it expires in a couple of months. I have my H1 approved for 2008 quota. My husband's H1 expires on sept 2007. we are applying for I-485 next month. Do i need to apply I-765 and I-131 because as per the instructions from my attorney it says the following:
-I-765 or EAD card. If you have valid H-1B valid more than one year and will not change job, you do not need EAD.
-i-131 or Advance Parole. If you have valid H-1 or H-4 visa stamping valid more than one year of if you are Canadian citizen, you do not need AP
Please clarify me whether I-765 and I-131 is required for our case.

I want to apply for my 3 yrs H extension using preminum processing. Can i do that by just using the email confirmation from USCIS that I-140 petition was approved? My 1-140 petition was approved in Dec,2006 and still have not recived my approval notice.

that applies only if you are on F1 visa (still considered a student), so you dont owe social security and medicare.
