Employment Letter is a part of the initial evidence. There is a memo recently saying that any missing initial evidence will result in denial of application without RFE. Try to cajole your employer and gather as much evidence as you can about being asked for $$$ for helping you file 485

If EB2 you may receive within 2 to 4 years from your PD and if EB3 then 4 to 6 years from your PD. But it will change postively if there is increase of GC temporary or permanent. It will change negatively if they increase H1b and not GC

I've been reading a lot regarding how many people is submitting their application this month, some how after see the possible figures I feel demoralized, looks like before July 2007 all of us were having an idea of our process, then the USCIS mess appeared and now I have no idea of when I will receive the GC or if some day I will receive it.

The USCIS just gave us the sense of advancement but in reality they did not giveus anything, just look the facts, you will have EAD and PAD, but if your I140 or I485 fail then you will be ouf of status, so many people will decide to maintain their H1B status, so why did we apply?

Can any one elaborate or give an estimate of when will we be receiving our GC (whe nI say we I'm thinking in all the people applying under the Visa Bulletin 2007 mess).

Hi, I am in 8th year of H1b with 140 approved (EB3) from company A. I would like to switch to company B and planning to start EB2 quickly to enage a new interesting project . I have following questions related to the same and early advice from you all would be highly appreciated as am running out of time in engaging the new project.

1. Can I do H1 transfer from company A to company B using A's 140 approval after my 6 years of original h1b quota. I am currently on 8th year of h1b.

2. Can I able to port the priority date from company A's EB3 filing with the new EB2 filing from company B?

3. If company A cancels the 140, still can I able to port the PD ?

If your I-140 is approved and dates not current you can get one time three years H1 extension. Otherwise one year extension is available.
Since your I-140 is approved You can port the priority dates even if Company A revokes the I-140

That's why you get up at 4:30! My friends make fun of me for that... The successive ridgelines in the fog make for a real feeling of depth. I've tried that technique a few times, but never pulled it off this well. I also like the aspect ratio you chose, it contributes to the 3-D, receeding-to-a-point, effect. The color here is likewise very nice. The only thing I would say could be better is that the sun is distorted by the cloudline. It would be better if totally obscured, or better resolved. In any case, you can't control the clouds. Super shot.

My 6th year of H1b is expiring in the Sep 26, 2008. I already applied for my H1b renewal and already got the receipt. I'm Eb3 - ROW.

My and my wife also applied for our EAD renewal in jun 1, 2008 (Nabraska). didn't receive anything till now. My wife needs that to continue with her job, we already expedite the process last week.

I also visited home couple of months and and entered Us using my AP.

I have some question regarding all those issues:

1) Can I get a business license when i'm working with the H1b and have the EAD?

2) Does it going to have any effect on my green card process or H1b status?

3) If i have the problem then can i open the business license under my wife's name as she will be in the EAD.

4) My PD is May 2006. Any chance it will be current in next 6 months?

Please give your feedbacks with your expertise guys. it's been very help for long time for me. Thanks ahead

My PD is not in this range. Mine is July-2001 kind of >= 2002.

I have seen an ALIA observation on EB2 Retro. Trying to figureout how soon these Visa #'s for EB2 catagory is vanished. I will have an analysis from this will post here.

that's excellent news, but may not be very helpful for those whose priority dates are retrogressed, whether the I-140 is approved in 1 month, or 12 months.

Premium processing (i.e. PERM) helps labor applicants more because of the difference in processing times between regular and PERM processing.

For I-140 the average processing time is about 3 months only (source: http://www..com/usa-immigration-trackers/i140-graph/), so what's the big advantage of premium processing for I-140? Are they going to approve I-140 in one day with premium processing?

I moved to a different place (same city), but my wife is out of country. I am trying to file AR-11 for change of address, but it is asking for Last Port of entry. Is AR11 needed only for people who are currently in the country.

She needs to fill-in new address in the I-94 form at the time of reentry into the US. She won't need to file AR-11, as her I-94 has most recent address.

Iam in a similar situation as Ihitha. Iam planning to go to Chennai in June for stamping. Which answer do you think would be a convincing one for that question asked by the VO ?

Also after changing from L1 to H1, i had my H1 transferred between 3 companies (i changed jobs within a span of 1 month), and the current employer iam working for, iam working for about 1 year and 3 months. When i go for stamping, would they be asking for paystubs from those two companies, or does it matter only with the latest company iam working for ?
It wouldd be great if someone can help me with some suggestions.

Pessimistic: EB2 India will slow down due to large number of cases during 2003-2005
Realistic: I dono!

Even though your end client is not the direct client for your employer, they might have used the laguage in the non-compete which reflects the scenario. So check your non-compete document.

May be the final verdict is in favour, you need to take so much of pain in the whole processes. If you prepare for these upfront you can go a head and fight. I had seen couple of instances in the NY, with my friends, where non-compete became VOID.

... But the consulting firm advised against it as according to them if she re-enters in H4 (even before Oct 1) while her H1 approval is pending, her H1 application will be cancelled and she has to restart the process all over again. Something to do with the last status on re-entry.


I think this issue used to be there. Why do you think otherwise? COS is not computerized to happen on Oct 1. It is manual process, while approving H1B, it is done. When someone enters after that on H4, then that COS is overwritten.

What lawyer is telling in this regard?

This appears to be more relavant given the need for rejuvenating the state chapters. Why not we have this as simple links on the main page itself and make it damn easy to join the chapter. The most important thing to do is to have the members join the chapters and have the contact numbers. Once these are there the IV state chapters could follow up and get the activities rolling with these members.

Bottom line: Have the state chapter joining links on the main page and have it simplified for the members to join very easily ( kind of taking the name, contact number and email and nothing more) later the chapter core could get in touch with them and get the complete profile. A kind of marketing gimmick.

Another alternative is to take infopass and explain the situation to them and take the letter with you so that can send it to the proper place.

Also call the IO directly at 1800-375-5283, 1,2,2,6,1...3,4

My wife got a job offer on contract basis for 3 months. I am on h1 and she is on h4 so far. I am planning to stay on h1 itself. If my wife accepts this job using EAD, Does my status also changes? Is it okay if she dont find a job after this contract expires, what status she will be in during that time, h4 or EAD?

If she stays put in US , Effective Oct1st, her status will be H1.
If she goes out of the country and enters back using her H4 stamping, she will be on H4.
If she intends to work, she will have to either apply for Change of Status from H4 to H1 or needs to go for H1 stamping and enter US using that stamp.

Following is the situation:

My H1 (6 years) expiring on 7th Mar'08 (have 35 days of vacation might be good till 11th Apr'08)
Labour filed on 06/20/2007 , still awaiting..(so 365 days rule does not apply for 7th yr ext)
Spouse was on H4, got H1 in Oct'2007 (no stamping done for H1).

Falling short of 10 weeks to get the 365 days rule

Options that I learnt for me getting 7th yr extension and staying in the country:

Option1:
Convert to H4 toward the end of H1 6 yrs expiry date till June 20th(to get the 365 days rule in effect)
File for 7th year extension based on the 365 days rule
Convert from H4 to H1 and start working.

Option 2:

Get Canada working visa (not sure how long it will take to get though) and work till June 20th there (to get the 365 days rule in effect)
File for 7th year extension based on the 365 days rule
Stamping in canada to return to USA.
(I am hoping 7th year extension can be done while I am outside the country)

Option 3:

Go back to India for 3 months wait till June 20th,
File for 7th year extension based on the 365 days rule
Stamping in India to return to USA.
(I am hoping 7th year extension can be done while I am outside the country)


Option 4:

Leave for India immediately and stay there for 10 weeks and recapture them along with 7th year extension(while I am in India )

Can the gurus/experts please put in any issues I might be running into or if any of the option above are not at all feasible(may be I am ignorant)

I am creating this post to benefit all.
Also this case is about my friend.
He shared all this information with me.

This is a Pittsburgh PA based case, YMMV.

My friend who has an approved labor/i140 and also a pending i485, received a news that his father was ill in India. He wanted to fly to India right away but his AP had expired. Here is what our Internal Immigration lawyer suggested him....

"You must go to the district office to screen and make a determination as to whether your situation is a qualifying emergency. They are responsible for accepting and processing the I-131 in emergency situations. Here is a link to the address and appointment procedure for the Pittsburgh office. https://egov.uscis.gov/crisgwi/go?action=offices.detail&office=PIT&OfficeLocator.office_type=LO&OfficeLocator.zipcode=15220 You should take a completed I-131, $305 filing fee, 2 passport photos, passport (and copy), I-94 copy and evidence of your father�s situation. Remember that you have to prove that this is a medical emergency."

So he took an Infopass appointment, which he got for the very next day! He then visited the Pittsburgh local office (which is normally not so busy) with a completed i-131, photos, fees, passport, copy of passport, i-94 and a FAX proof from India Doctors which explained his fathers situation.

An interview took place, where they asked expected questions and then an Internal Director approved. He was told to wait for 1 hour and he was handed 2 copies of temporary Advance Parole which is valid for 4 months.

I myself was wondering if one can get emergency advance parole and this example shows that if you show all the proof and go to a local office they will help you as much as possible and also give you an AP within 1-2 hours.

(The only bad thing is, my friend will have to spend $305 again for an approval which lasts for 1 or 2 years)

My EAD card was returned as undeliverable as Mail Box didn't have my name on it.

I changed my address and requested the Card to be resent. CSR said it would take 3-5 business days.

I spoke with a IIO today and she said it would take 4- 5 months to get remailed as per their policy.

Which one is right ,CSR/IIO?
Is there anything that I could do to get my card earlier?

You need to have a job offer, a LCA for the job, educational evaluation, I-129 and copies of your passport/i94 and degree. A supporting letter from the employer is also needed. No experience letter is needed to apply for H1, but to get it stamped you may need it.

My wife and I both came back on AP through Frankfurt on Feb 3rd. We do not have stamped H1-B visas in our passports. You do not need Transit Visa. Transit through Frankfurt is very easy and hassle-free. Security and immigration personnel in Frankfurt are very friendly and nice.

As far as I know, any person can stay in US legally only on one visa at any point of time. That said, the moment you switched to L1, your H1 is invalid. I'm pretty sure that you can't use your previous H1 extension and you have to file for new H1 petition which starts in April 2008.

I have a question about the Aytes memo - it says that if the name check has been pending for more than 180 days, then the 485 will be adjudicated. My question is when does the 180 day clock start? Is it on the day that the 485 application was received by the service center (going by the receipt date on the 485 notice)? Or is it the day when your PD and processing dates both become current?

Greetings all,

I am new to Immigration voice and feel very blessed for finding the site.

Here is my situation I am a green card holder since 1996. However I waited until now because I had I received probation before judgment in 2003. The case was expunged in 2007. The conviction was Annotated Code of Maryland article 27 , section 146 (c )(1 ) stipulating that : Any person who violates any provision of subsection (c)(1) of this section is guilty of a misdemeanor and on conviction is subject to a fine not exceeding $1,000 or imprisonment not exceeding 3 years or both.

According to the information I found on USCIS, you can not have any conviction in the five years preceding your application; It looks like I should be fine. I am ready to apply now and it has been a good obedient green card holder for 6 years now, I don't have any issue with the law since 2003.

I am also married to a US citizen and have three children (all citizens). I was able to get all my information from the court prior to the expungement as well.
